CAKE ORDERING
1) All prices are excluding delivery charges.
2) Cake designs are subjected to slight variations and availability of decorative accessories.
3) Cake colour and decorations may be subjected to slight variations from actual product due to possible discrepancies in photo to screen resolution.
4) Fresh fruits are seasonal and sweetness cannot be assured.
5) We reserve the rights to substitute, change,accept or reject any orders or cake designs.
ORDER CONFIRM
You will receive our confirmation call within 24 hours after order made. If not, please don't hesitate to contact us by call or email.
CANCELLATION OF ORDER
Your order will be cancelled when :
1) We cannot get your confirmation.
2) We do not receive your payment or payment proof within 48 hours after order made.
EXCHANGE
Items sold are not exchangeable.
CHANGES IN ORDER
Any changes pertaining to the order must be made 1 days before collection date. We reserve the right whether to accept or reject the particular changes request.
CANDLES REQUEST
Complimentary candles will be provided for every cake order when requested by customers.Please indicate the correct number of big and small candles required. We will process the order according to sender's request. (note : we only provide max up to 9 big candles and 9 small candles)
WRITINGS ON THE CAKE
Customers may request for writings on the cake. Please indicate the wordings correctly upon placing your order. Do note that due to space constraint on the cake surface,lengthy wordings may not be accommodated. We reserve the rights to accept or reject any request of writings on the cake. It is customer's duty to ensure that such requests are acknowledged by KELLY CAKE HOUSE.
DEPOSIT
All deposit made are not refundable.
GENERAL RULES RELATING TO CONDUCT
The App is made available for your own, personal use. The App must not be used for any illegal or unauthorised purpose. When you use the App you must comply with all applicable Malaysia laws and with any applicable international laws, including the local laws in your country of residence (together referred to as“Applicable Laws”).
You agree that when using the App you will comply with all Applicable Laws and these Terms. In particular, but without limitation, you agree not to:
1) Use the App in any unlawful manner or in a manner which promotes or encourages illegal activity including (without limitation) copyright infringement; or
2) Attempt to gain unauthorised access to the App or any networks, servers or computer systems connected to the App; or
3) Modify, adapt, translate or reverse engineer any part of the App or re-format or frame any portion of the pages comprising the App, save to the extent expressly permitted by these Terms or by law.
You agree to indemnify KELLY CAKE HOUSE in full and on demand from and against any loss, damage, costs or expenses which they suffer or incur directly or indirectly as a result of your use of the App otherwise than in accordance with these Terms or Applicable Laws.
CONTENT
The copyright in all material contained on, in, or available through the App including all information, data, text, music, sound, photographs, graphics and video messages, the selection and arrangement thereof, and all source code, software compilations and other material (“Material“) is owned by or licensed to KELLY CAKE HOUSE. All rights are reserved. You can view, print or download extracts of the Material for your own personal use but you cannot otherwise copy, edit, vary, reproduce, publish,display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the Material without Future’s express permission.
The trademarks,service marks, and logos (“Trade Marks“) contained on or in the App are owned by KELLY CAKE HOUSE or third party partners of KELLY. You cannot use, copy, edit, vary, reproduce, publish,display, distribute, store, transmit, commercially exploit or disseminate the Trade Marks without the prior written consent of KELLY CAKE HOUSE or the relevant third party partner of Kelly Cake House.
SERVICE SUSPENSION
KELLY CAKE HOUSE reserves the right to suspend or cease providing any services relating to the apps published by it, with or without notice, and shall have no liability or responsibility to you in any manner whatsoever if it chooses to do so.
